Terms of Service

These terms govern your use of the motanya.co.ke website ("the site"), operated by Motanya, a systems engineering practice based in Nairobi, Kenya. By using the site, you agree to these terms. If you don't agree with them, please don't use the site.

The site describes the services Motanya offers — ERP implementation, systems integrations, legacy system automation, mobile applications, and network and infrastructure work — and provides a way to get in touch about them. Nothing on the site is an offer capable of acceptance; it's informational, and any actual engagement is governed by a separate written agreement between Motanya and the client.

You agree to use the site only for lawful purposes. You agree not to:

• Attempt to gain unauthorised access to the site or its underlying systems.
• Interfere with the site's normal operation, including via automated scraping or overload.
• Use the contact form to submit false, misleading, or malicious content.
• Reproduce, resell, or repurpose site content for commercial use without permission.

Unless otherwise noted, the text, layout, design, and branding on this site are the property of Motanya and may not be copied or reused without prior written permission. Project imagery and third-party assets remain the property of their respective owners.

This site does not itself create a contract for services. Any actual project — scope, pricing, timelines, deliverables, and liability for that work — is governed by a separate signed proposal, quote, or contract agreed between Motanya and the client. Where these Terms and a signed project agreement conflict, the signed agreement takes precedence for that engagement.

The site and its content are provided "as is." While we make a reasonable effort to keep information accurate and the site available, we don't guarantee it will be uninterrupted, error-free, or fit for a particular purpose.

To the extent permitted by Kenyan law, Motanya is not liable for any indirect, incidental, or consequential loss arising from your use of this website. This does not affect any liability arising from a separately signed client agreement, which is governed by the terms of that agreement.

The site may link to third-party platforms, such as GitHub or LinkedIn. We aren't responsible for the content, availability, or practices of those third-party sites.

These terms are governed by the laws of the Republic of Kenya, and any dispute arising from them will be subject to the jurisdiction of the Kenyan courts.

We may update these terms from time to time. Continued use of the site after a change constitutes acceptance of the updated terms. The "last updated" date above always reflects the current version.
